What is insurance bad faith?
Insurance policies are legally binding contracts. The policyholder pays insurance premiums and the insurer agrees to indemnify and defend you if a covered event occurs.
When an insurer fails to honor the terms of the policy (the contract) the insured may have a claim for insurance bad faith.
Bad faith is defined as: an intentional dishonest act by not fulfilling legal or contractual obligations, misleading another, entering into an agreement without the intention or means to fulfill it, or violating basic standards of honesty in dealing with others.
What happens when an insurance company refuses to pay you the benefits to which you are entitled?
You need an aggressive and experienced trial attorney to take on your insurance company and demonstrate insurance bad faith in refusing to pay you. Bad faith insurance cases are "torts" which means you may be able to sue for damages in addition to reimbursement for any expenses you incurred as a result of a denied claim including lost wages, cost of treatments and medical care expenses.
Bad Faith When an Insurance Company Illegally Cancels Your Insurance
Sometimes, an insurance company will cancel (rescind) your insurance policy retroactively after you file a legitimate claim. This practice is known as insurance rescission. In California, post claims underwriting (investigating an insured's application after a claim is filed) is illegal. Unfortunately for policyholders, many large insurers still illegally rescind insurance policies. When they do, this is also an act of insurance bad faith for which the insured is entitled to damages.
