On May 7, 1999, Jerry Layne, a 44-year-old Major League Baseball umpire and two other umpires were driving home from umpiring that night's Dodgers game. They were rear-ended by the defendant's vehicle, causing $300 property damage. Mr. Layne suffered nerve damage to his pinkie finger.

Mr. Alder successfully argued that, although there is not loss of function, the umpire has permanent numbness in his pinkie.

Mr. Layne incurred $10,500 in medical Expenses and missed one day of work. The jury returned a verdict in the amount of $907,986 and stayed for autographs after the trial.
