On August 25, 1999, 44-year old Victor Medina was stopped, or nearly stopped, at a stop sign, while driving a Ford 15-passenger van. The Defendant's 18-wheeler rear ended Mr. Medina's vehicle, causing approximately $500 in damage to the van's bumper and no damage to the 18-wheeler. Following the accident, Mr. Medina returned to work, and began to suffer lower back problems over the ensuing weeks.

Mr. Medina had been a salesman for Keystone Ford. Due to his injury, he was unable to straighten or rotate his back, causing immense pain and psychological trauma.

Mr. Alder utilized demonstrative graphics, showing the construction of the driver's seat, and how the injury was consistent with the structure of the van seat. The Santa Ana case settled days before trial for $750,000.
